1. Overview of Services

LoanWise provides an online platform offering various tools and information to help users make informed decisions about loans and financial products. Our key services include:

Loan Calculators and Tools: Interactive calculators for mortgages, personal loans, and other financial products to estimate payments, interest, and other loan metrics. These tools are provided for your personal informational use and educational purposes.

Interest Rate Forecasts and Projections: We may display current interest rates and projections or forecasts of future rate trends. These forecasts are estimates for informational reference only and not guarantees of future rates or outcomes.

Lender Matching Service: A quote request system where you can submit information about the loan you're seeking. In response, we attempt to match you with one or multiple third-party lenders or loan providers (“Providers”) who may offer conditional loan quotes or offers. This allows you to comparison-shop for loan offers from our network of participating lenders.

No Professional Advice: All content, calculators, forecasts, and tools on our Site are provided for general information and educational purposes and do not constitute financial, legal, or other professional advice. LoanWise is not a financial planner, advisor, or attorney. You should consult qualified professionals before making any significant financial decisions or relying on information from our Site.

Not a Lender: LoanWise is not a lender, bank, or creditor, and we do not originate loans or make credit decisions. We do not take loan applications, make loans, or issue loan commitments or approvals ourselves. Our role is exclusively as an intermediary to facilitate your connection with third-party lenders and to provide information. Any services we provide are administrative in nature – we help you gather information and connect with Providers, but we do not lend money or make credit offers to you.

2. Eligibility and User Requirements

U.S. Residents and Age Requirement: Our services are intended for users located in the United States. We make no representation that our Site or content is appropriate or available for use outside the U.S.. By using LoanWise, you represent and warrant that you are at least 18 years old (or the age of legal majority in your state) and legally capable of entering into binding contracts. If you are under 18, or if you are not a resident of the United States, you may not use our Site or submit loan inquiries.

Personal Use Only: The Site and services are provided for your personal, non-commercial use. You agree that you are using our tools and services for your own behalf and not on behalf of any other person (except as allowed, for example, co-borrowers in a joint inquiry). You may not resell, deep-link to, frame, or distribute any part of our Site or services without our prior written consent.

Your Account: If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information when creating an account or submitting information to us. You are solely responsible for the security of your account and must promptly notify us of any unauthorized use. We reserve the right to refuse service, suspend accounts, or terminate accounts if we suspect unauthorized use or a violation of these Terms.

3. Loan Quote Inquiries and Lender Matching

Our lender matching and loan inquiry service allows you to request loan quotes from multiple lenders:

Submitting an Inquiry: When you fill out and submit a loan quote request or “Qualification Form” on our Site, you are providing information (such as contact details, income, loan preferences, etc.) in order to be matched with participating third-party lenders or loan brokers. Submitting an inquiry is not a formal loan application for credit; it is only a request to be matched with potential lenders who may provide conditional loan offers. You may need to complete a separate, full loan application with a lender before you receive a final loan approval or terms.

Consent to Share Information: By submitting a loan inquiry, you consent to LoanWise sharing the information you provide with relevant third-party Providers (lenders, brokers, or mortgage companies) for the purpose of matching you with loan offers. This may include sharing your information with multiple lenders so that they can evaluate your request and, if appropriate, provide you with conditional quotes or offers. If you do not want your information shared with lenders, do not submit a quote request. Please refer to our Privacy Policy for details on how we handle your personal information.

Consent to be Contacted: By using our lender matching service and providing your contact information, you provide your prior express written consent to receive calls, text messages (SMS), and emails from LoanWise and its network of lending partners, including calls and texts made using an autodialer, prerecorded or artificial voice messages, at the phone number and email address you provided, even if your number is listed on any company-specific, state, or federal do-not-call list. These communications are intended to provide you with information or offers in response to your inquiry. Message and data rates may apply. Message frequency may vary. Consent to receive such communications is not a condition of purchasing any goods or services. You may revoke your consent at any time (see “Consent Revocation” below). Standard messaging and data rates may apply. You can also opt out of communications from a specific lender by directly informing that lender.

No Obligation or Guarantee: You are not obligated to accept any loan offer you receive from a lender. Submitting a request or receiving conditional offers does not guarantee that you will receive a loan or any particular terms. All conditional loan offers are subject to the lender's review of your full application, verification of your information, credit checks, and other underwriting criteria. We do not guarantee that you will be matched with a lender, that any lender will make you an offer, or that any offer will meet your expectations or needs. Lenders alone set and determine their own lending criteria and product terms, and we have no control over the decision a lender makes on whether to extend credit to you or the terms of any offer.

Conditional Nature of Offers: Any loan rates, fees, or terms that you see through our service (such as in a quote or rate table) are conditional and subject to change. For example, interest rates and loan terms presented in initial quotes are estimates based on the limited information you provided. Final rates and terms, including closing costs or fees, will be determined by the lender after you complete a full application and the lender obtains and evaluates necessary information (such as your verified credit score, income documentation, property appraisal, etc.). Sample or advertised rates on our Site do not constitute a guarantee that you will qualify for those rates or that those rates will be available at the time of closing. Interest rates can change daily, and lenders may adjust their offers at their discretion without notice.

Provider Terms and Conditions: Any loan or financial product offer that you may receive through our Site will be subject to separate terms and conditions established by the third-party Provider. It is your responsibility to review all the details, terms, fees, and conditions provided by the lender before making any decision. LoanWise is not responsible for the content of the offers (such as the accuracy of interest rates, fees, or loan terms) provided by the lenders. If you choose to proceed with a particular lender, you will enter into a separate agreement with that lender, and that agreement will solely govern your relationship with the lender.

Electronic Signature and E-Sign Consent: By checking any consent checkbox and clicking any submission button on the Site (such as “Get My Rate,” “Submit,” or similar), you are providing your electronic signature and affirmatively consenting to the terms presented alongside that action. You agree that your electronic signature carries the same legal force and effect as a handwritten signature, and that your consent constitutes “prior express written consent” as defined under the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. This electronic signature process is conducted in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and applicable state laws governing electronic transactions. By using the Site, you confirm that you have the ability to access, retain, and print electronic records and that you consent to conducting business electronically with LoanWise. You may withdraw your consent to electronic communications at any time by contacting us (see Contact Us below), but doing so may limit your ability to use certain features of the Site.

SMS/Text Messaging Terms: When you provide your phone number and consent to receive text messages from LoanWise or its lending partners, the following terms apply: Message frequency may vary depending on your inquiry and interactions. Message and data rates may apply depending on your wireless carrier and plan. You may opt out of receiving text messages at any time by replying STOP to any message you receive. Upon receipt of your STOP message, we will send a confirmation message; after that, you will no longer receive text messages from LoanWise. You may also opt out by emailing us at the address provided in the Contact Us section below or by any other reasonable method. For help, reply HELP to any message or contact us at the email address provided in the Contact Us section below. Carriers are not liable for delayed or undelivered messages. LoanWise will not share your mobile opt-in consent or phone number with third parties for purposes unrelated to providing the services you requested. Text message consent collected on the Site will not be shared with third parties or affiliates for their own marketing purposes.

Consent Revocation: You have the right to revoke your consent to receive communications from LoanWise at any time and by any reasonable method. Reasonable methods include, but are not limited to: replying STOP to any text message, sending an email to our contact address with the subject line “Revoke Consent,” calling us and requesting removal, or submitting a written request by mail. We will process your revocation request within 10 business days of receipt. Please note that revoking consent applies to future communications from LoanWise only. If your information has already been shared with lending partners pursuant to a loan inquiry you submitted, you will need to contact those partners directly to opt out of their communications. Revoking consent will not affect any prior communications or any ongoing obligation you may have with a lending partner.

4. LoanWise is Not a Lender or Financial Advisor

LoanWise acts only as an intermediary to connect you with lending partners and to provide general loan information. We are not a lender, creditor, bank, or financial institution and we do not make loans or credit decisions in connection with loans. Because we are not a lender, we do not:

• Guarantee any loan results or specific outcomes from using our Site.
• Take or process formal loan applications, make credit decisions, or issue loan commitments/approvals.
• Charge you any fees for using our service (see Section 5 on Fees) or collect loan payments.
• Act as an agent or representative of any lender or of you in any transaction.

Furthermore, while we strive to provide useful information (such as calculators and rate projections), LoanWise does not provide financial, legal, or investment advice. Any information you obtain through our Site (including loan comparisons, articles, interest rate forecasts, or calculator results) is provided “as is” for informational purposes only. It should not be relied on as professional advice or the sole basis for making important financial decisions. Always consider seeking advice from a qualified financial advisor or other professional who is aware of your individual circumstances. You agree that you are responsible for your own financial decisions and that LoanWise is not liable for decisions you make based on information on our Site.

5. Fees and Compensation

Free Service for Users: There is no cost to use the LoanWise Site or any of our calculators, tools, or lender matching services. We do not charge you any fees or require any subscriptions for our services. You can use our tools and request loan quotes free of charge.

How We Make Money: LoanWise may be compensated by third-party lenders, brokers, or other partners (collectively “partners”) for the services we provide. In many cases, we receive a marketing or lead generation fee from lenders when we refer potential customers (like you) to them. For example, if you submit a loan inquiry through our Site, a participating lender that receives your inquiry may pay us a fee for that referral. This is how we are able to offer our comparison services to you at no direct cost.

No Endorsement & Limited Offer Set: Compensation from partners does not constitute an endorsement or recommendation of any lender or loan product by LoanWise. We remain an independent platform; however, note that compensation may affect how and where lenders or offers appear on our Site (for example, the order in which loan offers are displayed might be influenced by our compensation arrangements). We strive to provide a range of options, but we do not claim to include every financial product or lender available in the market. The offers you see are limited to those from our network of participating Providers. You should always consider that other options or offers might exist beyond those presented by LoanWise.

No Broker or Origination Fees from Us: LoanWise itself does not add any fees to your loan. Any fees associated with a loan offer (such as origination fees, application fees, appraisal fees, etc.) are determined by the lender and will be disclosed by that lender in their offer or during the application process. We advise you to review all such fees carefully with any lender you consider.

6. User Obligations and Prohibited Activities

By using our Site and services, you agree to the following responsibilities and limitations:

Provide Accurate Information: You agree that all information you enter on our Site (for example, when using a calculator or submitting a quote request) is truthful, accurate, and current to the best of your knowledge. Providing false, outdated, or misleading information could result in inaccurate results or mismatched offers, and may also disqualify you from receiving actual loan offers. If any of your information changes (such as contact information) after you've submitted it, it is your responsibility to update that information with us or the relevant lender.

Use for Lawful, Personal Purposes Only: You will only use LoanWise for legitimate personal purposes. You agree not to use the Site or services in any way that is unlawful, fraudulent, or harmful. Prohibited activities include (but are not limited to):

No Illegal or Fraudulent Use: Do not use the Site to engage in any activity that violates any law or regulation, or to further any fraudulent scheme. This includes attempting to obtain loan offers under false pretenses or using someone else's identity or information.

No Unauthorized Access or Disruption: Do not attempt to interfere with the operation or security of our Site. This means you will not introduce viruses or malicious code, attempt to hack or gain unauthorized access to our systems or data, or attack the service (e.g., via a denial-of-service attack).

No Scraping or Data Mining: You agree not to use any automated system (such as bots, spiders, or scrapers) to extract data from our Site for any commercial or competitive purpose. You also will not attempt to reverse-engineer or bypass any functionality of the Site.

No Improper Use of Content: You will not copy, reproduce, distribute, or create derivative works from our content (such as calculator tools, text, or graphics) without our express permission, except as allowed by law for personal use.

No Spam or Unsolicited Communications: You will not use information from our Site to send unsolicited communications or marketing to any other users or lenders you encounter via our service.

Indemnification:You agree to indemnify, defend, and hold harmless LoanWise and their respective affiliates, members, managers, officers, directors, employees, contractors, agents, licensors, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to your access to or use of the Site or services, including but not limited to:

(a) your use or misuse of the Site or services, including your submission of information and your use of any calculators, tools, forecasts, or lender-matching services;

(b) any information you submit, transmit, or make available through the Site, including any allegation that such information is inaccurate, misleading, incomplete, or violates any applicable law or third-party right;

(c) your interactions, communications, or transactions with any third-party lender, broker, mortgage company, or other service provider obtained through or in connection with the Site;

(d) your violation of these Terms, any applicable law or regulation (including consumer protection, privacy, or communications laws), or any third-party terms, intellectual property, or other rights;

(e) any dispute, claim, or allegation arising between you and any third party (including lenders or service providers) in connection with your use of the Site or services; or

(f) your misuse of the Site or services, including any unauthorized, fraudulent, unlawful, or improper activity.

This means you are responsible for the consequences of your actions and agree to reimburse the Indemnified Parties for any losses or expenses they incur arising from such claims. This indemnification obligation applies regardless of whether such claims arise in contract, tort, statute, equity, or otherwise, and survives termination of these Terms and your use of the Site.

The Indemnified Parties reserve the right, at their sole discretion and at their own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with such defense.

7. Intellectual Property Rights

Ownership of Site Content: All content on the LoanWise Site – including text, logos, trademarks, graphics, software, calculators, articles, page design, and overall “look and feel” – is the property of LoanWise or our licensors and is protected by copyright, trademark, and other intellectual property laws. LoanWise retains all rights, title, and interest in and to its content and services. You are granted a limited, revocable license to use the Site and its content for personal, non-commercial use only. Except as expressly permitted by us, you may not copy, reproduce, republish, upload, post, transmit, or distribute any content from our Site.

LoanWise Trademarks: “LoanWise” and our associated logos, slogans, or product names are trademarks or service marks owned by us. You are not granted any right or license to use any LoanWise trademarks by using our Site. All other trademarks, product names, and company names (for example, the names or logos of lenders featured on our Site) are the property of their respective owners. Display of those trademarks on LoanWise is not intended to indicate any affiliation with or endorsement by us.

Your Feedback and Content: Typically, users do not post content on our Site apart from providing information in inquiry forms or contacting us. If you do submit any content to us (such as feedback, suggestions, or other communications), you grant LoanWise a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, publish, or incorporate that feedback or content into our products or services without compensation to you. This helps us improve our services. Please do not send us any feedback or information that you consider confidential or proprietary, as we reserve the right to use it as described.

8. Third-Party Websites and Services

Links to Other Sites: Our Site may contain links or references to third-party websites or services (for example, links to a lender's website, or informational articles on other sites). These links are provided for your convenience or informational purposes. LoanWise has no control over third-party websites or content, and we do not endorse, warrant, or assume responsibility for any third-party content, products, services, or information. We encourage you to review the terms and privacy policies of any third-party sites you visit.

Third-Party Services (Lenders/Brokers): When you interact with third-party Providers through our service (such as when you are matched with lenders, or if you choose to provide additional information to a lender outside of our platform), be aware that these Providers are independent third parties. We do not guarantee or make any representations regarding any loan or service provided by a third-party lender. Any relationship or agreement formed between you and a lender is solely between you and that lender. LoanWise is not responsible for the performance of any lender, the outcome of any loan application, or any agreement you enter into with a lender. We do not endorse any specific lender or loan product. It's your responsibility to evaluate the lenders' offers and to understand the terms of any agreement you enter.

No Agency Relationship: Nothing in our service or these Terms is intended to create an agency, partnership, or joint venture relationship between LoanWise and any lender or between LoanWise and any user. We are not an agent for any user or any third-party Provider. Our facilitation of connections between users and lenders does not make us responsible for any acts or omissions of those lenders.

9. Disclaimer of Warranties

“As Is” Provision: LoanWise provides the Site and all services and content on an “as is” and “as available” basis, without any warranty of any kind, either express or implied. While we strive to keep information up to date and accurate, we make no guarantees that the content on the Site is timely, accurate, error-free, or complete. For example, interest rate data, loan terms, or other information may change rapidly, and we cannot warrant that our posted information will always reflect the most current data.

No Warranties: To the fullest extent permitted by law, LoanWise disclaims all warranties and conditions of any kind, whether express, implied, or statutory. This includes, but is not limited to: implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components. Any downloading of material from our Site is done at your own risk, and you are responsible for any damage to your computer system or loss of data that results.

Informational Purposes Only: All information and tools provided by LoanWise are for informational purposes and no warranty or guarantee is made regarding their accuracy or applicability to your specific situation. 10. Limitation of Liability

No Indirect Damages: To the maximum extent permitted by law, LoanWise and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages that result from or relate to your use of (or inability to use) our Site or services. This limitation applies to any damages for lost profits, lost savings, lost opportunities, loss of data, or goodwill, even if we have been advised of the possibility of such damages. For example, we are not liable for you missing out on a loan or incurring higher costs because you relied on information on our Site, nor are we liable if our Site is unavailable for any period of time.

Cap on Direct Damages: To the extent permitted by law, in no event will the total aggregate liability of LoanWise (and its affiliates and agents) for any claims arising out of or relating to these Terms, the Site, or the services exceed $100 USD or the amount you have paid to us for services in the last six months (if any), whichever is greater. Because our services are free to users, it is agreed that $100 is the maximum liability in most cases. This limitation applies regardless of the form of action (whether in contract, tort, statute, or otherwise) and even if any limited remedy herein is found to have failed its essential purpose.

Third-Party Liability: LoanWise has no liability for any acts, errors, or omissions of any third-party lenders or service providers. As noted, the lender with whom you may deal is solely responsible for its own obligations, products, and services, and we are not liable for any dispute, claim, or issue arising between you and any third party. If you have a dispute with a lender or another third party (such as a credit bureau, insurance provider, etc.), you agree that LoanWise is not responsible for any losses or damages arising out of or in connection with such disputes.

Consumer Rights:Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. If applicable law limits the application of the above limitation, then LoanWise' liability will be limited to the extent permitted by law. These limitations are a fundamental part of this agreement and enable us to offer free services; we would not provide the Site without such limitations.

11. Privacy and Data Use

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy (available on our Site), which is incorporated into these Terms by reference. By using the Site or submitting any personal information, you consent to the practices described in the Privacy Policy. Here are some key points:

Personal Information for Quotes: To use our lender matching service, you will need to provide certain personal information (such as your name, contact information, etc.). We use this information solely to provide the services you request, for example, to match you with lenders and to allow lenders to evaluate your inquiry.

Sharing with Lenders: As described in Section 3, when you submit a loan inquiry, you authorize LoanWise to share the provided information with participating lenders, brokers, or partner companies so that they can respond with conditional offers. We will not sell or transfer your personal information to unrelated third parties for their own marketing use without your consent; however, by submitting an inquiry, you are essentially authorizing the sale/transmission of your lead information to lenders or mortgage companies, as that is how our service operates. We may sell or transmit your inquiry information to multiple participating lenders or mortgage companies in connection with your request. California residents may have additional rights under the California Consumer Privacy Act (CCPA). Please see our Privacy Policy for details.

Use of Information: We implement reasonable security measures to protect your information. However, you acknowledge that no data transmission or storage can be guaranteed 100% secure. LoanWise may use your information internally to improve our services, analyze usage, comply with legal obligations, or communicate with you (for example, sending confirmation of your inquiry or relevant updates).

Third-Party Privacy: Once your information is shared with a lender or Provider, that third party will handle your data according to their own privacy practices. LoanWise is not responsible for how those third parties may use your information. We encourage you to review any lender's privacy policy or disclosures. If you wish to stop communications from a particular lender, you should notify that lender directly.

Do Not Track & Cookies: Our Site may use cookies or similar technologies to enhance user experience and for analytics. Details are provided in our Privacy Policy. We do not respond to “Do Not Track” signals, and third-party analytics providers may collect information about your online activities over time and across different sites when you use our Site.

12. Changes to Terms and Services

Changes to Terms: LoanWise reserves the right to modify or update these Terms at any time. We will not be liable if any part of the Site is unavailable or if any feature is changed or removed.

13. Termination

By LoanWise: We may suspend or terminate your access to the Site and services at our discretion, at any time and without liability, if we believe you have violated these Terms or for any other reason (including inactivity or technical reasons). For example, if we detect fraudulent activity or misuse of the Site from your account, we may terminate or suspend your account immediately. We may also terminate the services or this agreement for convenience by providing notice to you (for instance, if we decide to discontinue the Site entirely).

By You: You are free to stop using our Site at any time. If you have an account, you may deactivate or delete it by following the instructions on the Site or contacting us. Stopping use of the Site or deleting your account does not absolve you of any obligations incurred under these Terms or affect any liability that may have arisen.

Effect of Termination: Upon termination of your access for any reason, these Terms shall survive to the extent applicable. In particular, any provisions relating to intellectual property, disclaimers of warranty, limitations of liability, indemnification, dispute resolution, and any other provisions which by their nature should survive termination, will survive the termination of this agreement. If your use of the Site is terminated, you must cease all use of the Site and destroy any copies of Site materials you have made.

14. Governing Law and Dispute Resolution

Governing Law: These Terms and any dispute arising out of or relating to these Terms or your use of the Site are governed by the laws of the State of California, USA, and applicable federal U.S. laws, without regard to its conflict of law principles. If you access the Site from outside the U.S., you do so on your own initiative and are responsible for compliance with local laws. We make no representation that the services or content are appropriate or available for use in jurisdictions outside the United States.

Agreement to Arbitrate: You and LoanWise agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site or services (collectively, “Disputes”) shall be resolved by binding arbitration on an individual basis, rather than in court, except for certain limited exceptions described below. By entering into this agreement, both you and LoanWise are waiving the right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration. This arbitration agreement is intended to be broadly interpreted and to survive termination of these Terms.

Exceptions: Notwithstanding the above, either party may choose to bring an individual claim in small claims court if the claim is within that court's jurisdiction and proceeding on an individual (non-class) basis. Additionally, any party may seek relief in court for claims involving intellectual property infringement or other equitable relief (such as injunctive relief).

Arbitration Procedure: Arbitration shall be administered by a neutral arbitrator agreed upon by the parties (or, if we cannot agree, by the American Arbitration Association “AAA” under its Consumer Arbitration Rules). The arbitration will take place in a location that is reasonably convenient for both parties (or virtually, if both parties agree), and the arbitrator's decision will be final and binding, with limited rights of appeal as provided by law. Each party is responsible for their own costs and attorneys' fees, but the arbitrator can award attorneys' fees to the prevailing party if allowed by law.

Class Action Waiver: All Disputes will be resolved on an individual basis only. You and LoanWise agree not to participate in any class, consolidated, or representative action or proceeding against each other. The arbitrator shall not have authority to combine or aggregate similar claims or conduct any class or representative proceeding, and can only decide the individual claim between you and LoanWise. If this class action waiver is found to be unenforceable or unlawful, then the entirety of the arbitration agreement in this Section 14 shall be null and void, and in that case you agree that the exclusive jurisdiction and venue described in the next paragraph will govern any disputes.

Jurisdiction for Litigation: In the event the arbitration agreement is found not to apply to you or your claim, or if you opt out of arbitration, you agree that any judicial proceeding (other than small claims actions) will be brought in the federal or state courts of competent jurisdiction in the State of California. Both you and LoanWise consent to venue and personal jurisdiction in California, and you waive any objections to such jurisdiction or venue (without prejudice to either party's right to remove a case to federal court, if permissible).

Opt-Out Right: You have the right to opt out of the binding arbitration and class action waiver provisions in this Section by notifying us in writing within 30 days of first accepting these Terms. To opt out, you must send an email to ...or a letter to our mailing address (provided in the Contact Us section) with the subject line “Arbitration Opt-Out” and your full name and the email address associated with your account. If you opt out of these provisions, LoanWise will not be bound by them either, but all other parts of these Terms will continue to apply. Opting out of this arbitration agreement will not adversely affect any other benefits you might receive from us.

Severability of Arbitration Provisions: If any portion of this arbitration agreement is deemed invalid or unenforceable, it shall not invalidate the remaining portions of the arbitration agreement, except as provided in the Class Action Waiver above.

15. Miscellaneous

Entire Agreement: These Terms (along with the Privacy Policy and any other policies or guidelines we provide) constitute the entire agreement between you and LoanWise regarding your use of the Site and services, and supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter. Any additional or different terms in any communications from you are void, unless expressly agreed to in writing by an authorized officer of LoanWise.

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions. The remaining Terms will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by LoanWise. A waiver of any term or condition is not a waiver of any other term or condition.

Assignment:You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms will inure to the benefit of and be binding upon each party's successors and permitted assigns.

Headings: The section titles in these Terms are for convenience only and have no legal or contractual effect.
